Welcome to Bakers Home Design Cakes! These Terms & Conditions (“T&C”) govern your access and use of our website www.bakershome.in, social media pages, and services. By using our website or placing an order, you agree to these terms.

If you do not agree with any of these terms, please do not use our website or services.

1. Definitions
   “We,” “Us,” “Our” refers to Bakers Home Design Cakes.
   “User,” “You,” “Customer” refers to any person accessing our website, placing an order, or engaging with our services.
   “Website” refers to www.bakershome.in, including all pages, content, and services provided through it.
   “Products” refer to cakes, cupcakes, and other baked goods offered by us.
2. Eligibility to Use the Website
   You must be:
   ✅ At least 18 years old or have parental consent to place an order.
   ✅ Legally capable of entering into a contract under the Indian Contract Act, 1872.
   ✅ Providing accurate and complete personal information for orders.

We reserve the right to refuse service to anyone who does not comply with these terms.

3. Ordering Process
   a) Placing an Order

📌 Advance Booking:

Regular cakes: 12 hours notice
Designer cakes: 24-48 Hours notice
Wedding & custom cakes: 24-48 Hours notice
b) Payment & Pricing
All prices are listed in INR (₹) and include applicable taxes.
We accept payments via UPI, Net Banking, Cash on Delivery (for pre-approved orders only).
Full payment or at least 50% advance is required to confirm custom cake orders.
📌 Price Changes: We reserve the right to modify prices at any time without prior notice because of raw materials price changes.

c) Cancellation & Refund Policy
a) Order Cancellation
❌ Cancellation Policy:

Orders canceled within 12 hours of booking: Full refund.
Orders canceled after 12 hours: No refund due to the perishable nature of cakes.
Wedding & Large Custom Cakes: Non-refundable after confirmation (due to material costs and labor).
📌 Exceptions:

If a cancellation is due to an emergency, we may offer a partial refund or store credit, at our discretion.
b) Refund Policy
🔄 Refunds will be processed only in the following cases:

Incorrect item delivered.
Severe damage during our delivery (must be reported immediately upon receipt with photos).
Order cancellation within the allowed timeframe.
📌 Refunds will NOT be issued for:

Personal dislikes (e.g., “I don’t like the taste”).
Minor design differences (see Order Disclaimer).
Accidental orders or last-minute cancellations.
💰 Refunds are processed within 5 business days to the original payment method.

d)Cancellation Waiver Clause
📜 By placing an order, you waive any right to dispute cancellations beyond the allowed time frame.

No-shows or uncollected orders will not be refunded or rescheduled.
In case of delivery refusal by the customer, the order will be marked as completed, and no refund will be issued.
If a customer provides incorrect delivery details, resulting in a failed delivery, no refund or replacement will be provided.
📌 We strongly encourage customers to double-check their order details before confirming.

4. Delivery & Pickup
   a) Delivery Terms
   🚚 Delivery Charges:

Free delivery within 15-20 km from our store Bellandur.
Additional charges apply for locations beyond the free delivery radius.
📌 We are not responsible for delays due to bad weather, traffic, or unforeseen events.

b) Pickup Terms
Customers opting for self-pickup must collect their order within the agreed time slot.
We are not responsible for cakes once they leave our premises.

5. Quality & Storage Guidelines
   ✅ Cakes are made fresh and should be consumed within 24–48 hours for the best taste.
   ✅ Storage Instructions:
   Fresh cream cakes: Refrigerate and consume within 48 hours.
   Buttercream cakes: Refrigerate and consume within 48 hours.
   Fondant cakes: Store in a cool, dry place (avoid refrigeration for long time).
   ✅ We are not responsible for product spoilage due to improper storage after pickup/delivery.
6. Customization & Design
   🎨 Customization Requests:

Custom cakes are made as per client instructions, but minor variations in color, shape, or design may occur.
We do not replicate copyrighted characters or logos without permission.
📌 We reserve the right to refuse requests that violate copyright laws or ethical standards.

7. Intellectual Property Rights
   📜 All content, images, designs, and branding on our website and social media are the property of Bakers Home Design Cakes.

You cannot copy, reproduce, or distribute our content without prior written consent.
Any unauthorized use may result in legal action under the Indian Copyright Act, 1957.

8. User Conduct
   🚫 You agree not to:

Use our website for illegal activities.
Submit false or misleading information.
Post abusive, offensive, or defamatory content in reviews or social media.
Attempt to hack, disrupt, or misuse our website.
📌 Violation of these terms may result in permanent ban or legal action.

9. Limitation of Liability
   🔹 Bakers Home Design Cakes is not liable for:

Any allergic reactions (customers must inform us of allergies in advance).
Accidental cake damage after delivery/pickup.
Website downtime, errors, or technical issues beyond our control.
Unforeseen circumstances affecting order fulfillment (natural disasters, strikes, etc.).
📌 Maximum liability is limited to the order amount paid by the customer.

10. Privacy & Data Protection
    🔐 We follow strict data security practices as per the Information Technology Act, 2000 & SPDI Rules, 2011.

Customer data is never shared or sold to third parties.
Payments are processed securely through trusted third-party gateways.

11. Governing Law & Jurisdiction
    📜 These T&C are governed by the laws of India.
    📌 Any disputes shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka.
12. Changes to These Terms
    We reserve the right to modify these T&C at any time. Updates will be posted on this page with a new effective date.
